How EU anti-money laundering rules threaten financial privacy

EU rules regarding anti-money laundering, counter-terrorist financing and sanctions law (AML/CFT) have increasingly shifted responsibilities to detect crime from public entities to companies . AML/CFT law requires “obliged entities”, like banks, to collect large amounts of financial and other personal data about their customers.
The way banks implement these rules in the EU has led to a systemic negative impact on human rights, often because of over-compliance, risk-aversion and weak accountability. This has been the case in the Netherlands where, among large number of human rights breaches by banks, Dutch ING Bank has even publicly apologised for discriminating against its customers based on profiling.

According to the human civil rights movements, the Swiss Ordinance on the Surveillance of Post and Telecommunications Traffic (VÜPF) significantly extends the obligation of metadata retention for large communications service providers. It also imposes user identification requirements on virtually all online service providers, including virtual private network (VPN) providers.
A coalition of international human and digital rights organizations, including Amnesty International and European Digital Rights (EDRi), urges the Swiss Federal Council to amend or abandon proposed changes that would expand mass data retention and user identification obligations for nearly all telecom and internet service providers.

the FBI and other U.S. government agencies have fought what is often called the “crypto wars”, the war on encryption In recent years, they have been joined by the European Commission. Under the slogan “what about the children,” they try to introduce total mass surveillance of all EU citizens — first through the proposed Chat Control legislation, and later via the Going Dark and ProtectEU initiatives. The goal is to legally mandate spy tools on every European smartphone and computer. The forces behind these efforts have turned out to be American tech companies and intelligence agencies.

Brad Smith, Microsoft’s president, told the FT that the rapid adoption of Chinese AI start-up DeepSeek’s technology in emerging markets such as Africa underscores the competition American firms face around the world.
His comments come as new research from Microsoft found that the release of DeepSeek’s R1 large language model a year ago helped accelerate the uptake of AI worldwide, particularly in the global south, due to its “accessibility and low cost”.
That has also led to China overtaking the US in the global market for so-called “open” AI models, which are often free to use, modify and integrate by developers.

Indian rocket launch loses control after liftoff in fresh blow to ISRO
An Indian rocket carrying 16 loads of equipment and experiments including an earth surveillance satellite went off track after liftoff on Monday in a fresh setback to the workhorse launch vehicle of the Indian Space Research Organisation.
The PSLV-C62 lifted off from the Satish Dhawan Space Centre on the island of Sriharikota at 10:18 a.m. (04488 GMT) carrying the EOS-N1 observation satellite and 15 other payloads developed by startups and academic institutions in India and abroad.

One source said the talks revolved around the sale of JF-17 jets, a multi-role combat aircraft jointly developed by Pakistan and China, and drones designed for surveillance and striking targets. Apps cannot access cameras, microphones or location services in the background when phones are inactive. Continuous status bar notifications are required when these permissions are active.
PERMISSION REVIEW ALERTS:
Devices must periodically display warnings prompting users to review all app permissions, with continuous notifications.
ONE-YEAR LOG RETENTION:
Devices must store security audit logs, including app installations and login attempts, for 12 months.
PERIODIC MALWARE SCANNING:
OPTION TO REMOVE PRE-INSTALLED APPS:
INFORMING GOVERNMENT OF MAJOR UPDATES:
TAMPER-DETECTION WARNINGS:
Devices must detect if phones have been rooted or “jailbroken”, where users bypass built-in security restrictions, and display continuous warning banners to recommend corrective measures.
ANTI-ROLLBACK PROTECTION:
Phones must permanently block installation of older software versions, even if officially signed by the manufacturer, to prevent security downgrades.

At the center of the criticism is the planned Article 88c, which provides for special relief for data processing in the context of Artificial Intelligence (AI). The experts Peter Hense and David Wagner warn here of an “unlimited special legal zone”. Since the term “AI system” is extremely broadly defined, companies could in the future declare almost any automated data processing as AI-relevant in order to evade strict data protection rules. This would replace the technology-neutral logic of the GDPR with a technology-specific privilege that primarily benefits service providers.
