The DOJ on Tuesday asked a federal appeals court to throw out the seditious conspiracy convictions of Proud Boys & Oath Keepers leaders who were sentenced to #prison terms for leading members of the #FarRight #extremist groups in attacking the US Capitol to keep #Trump in #power >5 years ago.

The affidavit quoted the detective as saying he clearly observed Gibson and Schultz “taunting and physically threatening members of the Antifa group” to provoke a physical altercation, despite video footage that the two hadn’t engaged in any threats or violence, according to the appellate opinion.

I haven't watched that footage in a while, but iirc the judge was solicitous enough to the fascists' objections that most of the remaining video had to be played without audio, so no one could hear any threats Gibson & Schultz may have made. Again, I can't recall in detail without revisiting, but the unaltered video is fucking bad and fucking obvious.
