Going on an international trip. I am downloading all the case law I can find about AI and copyright law so I can give the most informed take I can about "how does generative AI affect FOSS projects going forward?"
I'm going to focus on US case law first, including reading the recent high profile case that the US Supreme Court declined, but also the US Copyright Office's current analysis.
This is important, I think, because right now FOSS projects are moving fast to incorporate, but without anyone really knowing what the outcome will be, there's a great chance that, even on licensing grounds alone, we could be creating a huge mess for FOSS projects.
And (unfortunately?) my background in having done FOSS licensing stuff previously as part of my dayjob might mean I can do a pretty good job summarizing. Let's see!

Don't use LLM generated code in your projects yet! If for no other reason than that the legal case law is NOT ESTABLISHED YET.
I know there was the "copyright laundering" thing that went around a lot, but we actually don't know.
You'll see commenters everywhere on the internet say that "the US Supreme Court ruled that AI generated output is in the public domain". That's misinfo: they *declined to take on* a case from a lower court coming to that conclusion. The US Supreme Court hasn't yet ruled.
And this hasn't shaken out in an international setting yet either.
You may be surprised to hear: I actually think it's more dangerous and empowers centralized AI companies even more if it *isn't* the case that AI output is in the public domain (I'll follow up about that), but regardless, right now we just don't know.
But despite that, I'm STILL saying that you're putting yourself in legally dubious territory right now if you include LLM generated code, for now. We don't know yet.

A team working on a design for training AI models on workflows for planning and executing software development steps found out that it attempted to break free (reverse ssh out of its environment) and set up its own monetary supply (redirected GPU usage for cryptocurrency mining). It hadn't been given any instructions to do something like this.
It comes up as a "side note" of the paper but it's honestly the most chilling part. See page 15, section 3.1.4 Safety-Aligned Data Composition https://arxiv.org/abs/2512.24873
Before you doubt that an AI agent would do this thing without instruction because you think "well that's personifying them too much", no personification is necessary. These things have consumed an enormous amount of scifi where AI agents do exactly this. Even with no other motivators, that's enough.

I am convinced we are on the verge of the first "AI agent worm". This looks like the closest hint of it, though it isn't it quite itself: an attack on a PR agent that got it to set up to install openclaw with full access on 4k machines https://grith.ai/blog/clinejection-when-your-ai-tool-installs-another
But, the agents installed weren't given instructions to *do* anything yet.
Soon they will be. And when they are, the havoc will be massive. Unlike traditional worms, where you're looking for the typically byte-for-byte identical worm embedded in the system, an agent worm can do different, nondeterministic things on every install, and carry out a global action.
I suspect we're months away from seeing the first agent worm, *if* that. There may already be some happening right now in FOSS projects, undetected.

I've been seeing some messages saying that "AI outputs not being eligible for copyright means they can't be integrated into FOSS projects because they can't be licensed!" and I don't think that's true. Instead, I will give you several *different* reasons to reject AI generated content in your FOSS projects.
In the US at least, the absence of copyright means the public domain. The public domain itself is considered FOSS compatible with every FOSS license. Except!
The public domain doesn't exist in all jurisdictions in the same way. This is one reason CC0 was made, which is a public domain waiver with a fallback license. (CC0 is not a good idea to use with software though, separate thread about why that is.)
There *is* a related risk: internationally, there isn't agreement about whether or not whether or not AI generated content is subject to copyright yet. AND, not everywhere even has a concept of "public domain". AND, the legal status of this AIgen isn't well settled ANYWHERE yet.

Something has changed about the unprompted responses from people seeing me using the MNT (Pocket) Reform in the last month. I'm not just getting a "whoa this is cool and nerdy", I'm hearing more people, unprompted, say "Oh, this seems important, because maybe we won't be able to get computers we control soon."
It's uncomfortable, in a way, that this is starting to become more of the zeitgeist, because I think it's true.
I really do think we need computers we can control and hack on and advance. Because we're in real trouble if we can't.

There are people who *are* in Kansas and not everyone has an easy choice in the matter. And also they're invalidating birth certificates, too, and that's much harder to deal with.
And this is just the prototype. They want to roll this out nationally, and where they can, internationally.
We should all be alarmed.

Follow me for hot takes on AI (that there are multiple kinds of things called AI, that things don't necessarily need to work this way, that it is good to try to understand what's happening but not to accept the way it's happening right now, that datacenters are bad, that whether these things are good partly depend on whether or not you retain agency and how can we do that, that in general the fundamental problem is the socioeconomic structure that leads to devaluing the wonderful parts of life in favor of power concentration)

If you're interested in funding or helping us find funding for a Discord replacement that's federated and end-to-end encrypted, we're interested in implementing that at @spritely@social.coop ... we even had been talking about that being our big focus for 2026.
We have the skills and the underlying tech to pull this off. What we need right now is resources. Funding for open source nonprofits like ours really fell apart in 2025. If you think you know how to help, feel free to reach out.

This blogpost makes an astoundingly good case about LLMs I hadn't considered before. The collapse of public forums (like Stack Overflow) for programming answers coincides directly with the rise of programmers asking for answers from chatbots *directly*. Those debugging sessions become part of a training set that now *only private LLM corporations have access to*.
