I just read this book, "The Collapse of the Third Republic ". It covers a lot that is often glossed over in standard histories. There was also a possibility of sailing the fleet to the Caribbean, but in the end the Brits did not trust the French not to eventually hand to the Germans. The French government had not fled to Algeria or anywhere else but essentially dissolved itself and appointed Petain as Dictator. So Petain had whatever legitimacy was left, and he wanted to collaborate to save destruction and loss of life. If he had ordered the fleet to surrender they might have done it.
The Brits had an interesting parallel in the 2nd Battle of Copenhagen, where they attacked nominally neutral Denmark, shelled the city, and seized almost their whole fleet to keep it out of Napolean's hands.
